General Terms and Conditions
1. Identification and Purpose
These General Terms and Conditions of Contract regulate the distance selling relationship between Laboratorios Clerea S.L.U. (hereinafter, "Clerea Cosmetics") and the user or customer who purchases products through the website clereacosmetics.com.
The identification data of Clerea Cosmetics are those stated in the Legal Notice of this website.
The purchase of products through this website implies full and unreserved acceptance of these conditions. The customer declares to have sufficient legal capacity to contract and to be of legal age.
2. Products and Availability
The products offered are natural cosmetics. Each product is accompanied by a descriptive sheet detailing its main characteristics, ingredients (INCI), and price.
All orders are subject to product availability. If there are supply incidents, or if an item is out of stock at the time of processing the order, Clerea Cosmetics will inform the customer as soon as possible and will proceed to refund any amount paid, without prejudice to the customer's right to choose an alternative product of equal or greater value.
Clerea Cosmetics reserves the right to reject an order in the following cases: manifest error in the published price, indications of fraud, unforeseen inability to supply, or non-compliance with these conditions. In such a case, the customer will be notified, and a full refund of the amounts paid will be processed.
3. Prices and Taxes
Prices shown on the website are in euros (€) and include Value Added Tax (VAT) at the current rate applicable in Spain (21% for cosmetic products).
Prices do not include shipping costs, which will be added to the total amount before completing the purchase and are detailed in the Shipping and Returns Policy.
Clerea Cosmetics reserves the right to modify its prices at any time. However, products will be invoiced at the price in effect at the time the customer places the order.
4. Purchase Process and Contract Formation
To place an order, the customer must follow the online purchase procedure:
- Select the products and add them to the cart.
- Access the payment process and enter shipping and billing details.
- Select the payment method.
- Review the order summary and click on the "Pay" or equivalent button. At that moment, the customer fully accepts these General Terms and Conditions of Contract.
Contract formation: After completing the payment, the customer will receive an email acknowledging receipt of the order. This email is for informational purposes and does not imply definitive acceptance of the order by Clerea Cosmetics. The purchase contract is considered perfected when Clerea Cosmetics sends the customer confirmation of the order's dispatch, in accordance with Article 28 of Law 34/2002, on Information Society Services and Electronic Commerce (LSSI-CE).
If the order cannot be processed for any of the reasons indicated in section 2, Clerea Cosmetics will notify the customer and no charge will be made, or the amount paid will be refunded as soon as possible.
5. Payment Methods
Clerea Cosmetics accepts the following payment methods:
- Credit/debit card (Shopify Payments): Through Shopify Payments' secure payment gateway. Payment data is encrypted using SSL/TLS protocol. Clerea Cosmetics does not store full card data.
- PayPal: If you have an account on this platform. Payment is processed directly in PayPal's secure environment.
The Seller applies generally accepted industry information security measures to prevent unauthorized access to payment data.
6. Right of Withdrawal
The customer has the right to withdraw from the contract within 14 calendar days from the receipt of the order, without needing to provide any justification, in accordance with Article 102 of Royal Legislative Decree 1/2007.
The procedure, conditions, applicable exceptions (especially regarding unsealed cosmetic products), and the cost of return are regulated in the Shipping and Returns Policy, which forms an integral part of these conditions.
7. Legal Product Warranty
All products are covered by a legal conformity warranty of 3 years from delivery, in accordance with Royal Legislative Decree 7/2021, of April 27, which transposes Directive (EU) 2019/771 on contracts for the sale of goods.
The warranty does not cover:
- Deficiencies caused by negligence, blows, improper use or handling.
- Natural wear and tear or depletion of the product due to its ordinary use.
- Products that have exceeded their expiry date or the PAO (Period After Opening) indicated on the packaging, once opened by the customer.
8. Responsibility and Use of Cosmetics
Clerea Cosmetics guarantees that its products comply with Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products, and with current European health regulations.
Allergies and intolerances
The ingredients of each product are published on the corresponding product sheet in INCI format. The customer is responsible for reviewing this information before making the purchase, especially if they have known allergies or sensitivities.
Clerea Cosmetics will not be responsible for adverse reactions derived from previous allergies or intolerances of the customer that they knew or could have known by consulting the labeling, provided that the product is correctly formulated, labeled, and safe in accordance with current regulations. This limitation does not affect Clerea Cosmetics' responsibility for defective or incorrectly labeled products.
Usage instructions
The customer must follow the instructions for use and storage indicated on the packaging. Failure to comply with these instructions exempts Clerea Cosmetics from liability for any damages that may arise.

10. Online Dispute Resolution (ODR)

11. Applicable Law and Jurisdiction
These conditions are governed by current Spanish law, in particular by Royal Legislative Decree 1/2007, Law 34/2002 (LSSI-CE), and the Civil Code.
For the resolution of any dispute arising from this contractual relationship:
- If the customer is a consumer or end-user: judicial jurisdiction will correspond to the courts and tribunals of the consumer's domicile, in accordance with current procedural regulations and Article 90 of Royal Legislative Decree 1/2007.
- If the customer acts as a company or professional: both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Zaragoza.
